Acceptance of Terms

By accessing or using Selectory ("the Service", "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and the sole developer and operator of Selectory ("we", "us", "our"). We operate the Service independently as an individual developer.

Eligibility

To use the Service, you must:

  • Be at least sixteen (16) years of age.
  • Be a currently enrolled student at an academic institution.
  • Have the legal capacity to enter into a binding agreement.
  • Not be prohibited from using the Service under any applicable law.

By using the Service, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to terminate accounts found to be in violation of this section without prior notice.

Description of Service

Selectory is a web-based automation tool that assists users in completing online quizzes on supported learning management system (LMS) platforms. The Service uses browser automation and artificial intelligence to:

  • Log into your LMS account using credentials you provide.
  • Navigate to and extract quiz questions from supported quiz pages.
  • Generate suggested answers using an AI model.
  • Select answers in the browser on your behalf.
  • Retake quizzes automatically within your configured attempt allocation.

Selectory operates as an assistive tool. The quality, accuracy, and outcome of quiz results are not guaranteed.

Educational Use & Academic Integrity

Important Notice:Selectory is provided strictly as an educational assistance tool. We make no representation, warranty, or statement regarding academic integrity, institutional policies, or the permissibility of using this Service under your school’s rules or code of conduct.

By using the Service, you expressly acknowledge and agree that:

  • You are solely and fully responsible for determining whether using Selectory complies with your institution's academic integrity policies, honor codes, rules, and regulations.
  • We assume no liability for any academic consequences, disciplinary actions, suspensions, expulsions, or other penalties that may result from your use of the Service.
  • The Service does not endorse, encourage, or facilitate academic dishonesty. Any misuse in violation of your institution's policies is solely your responsibility.
  • We make no statement on academic integrity. The decision to use this tool is entirely yours, and you bear all associated risks.

User Account & Security

To access the Service, you must register an account using a valid email address and password. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the confidentiality of your account credentials.
  • Notify us immediately at tropeo123@gmail.com of any unauthorized access.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to the platform.

LMS Credentials, Shared Accounts & Data Handling

Selectory supports linking one LMS account to multiple Selectory users when users deliberately configure that shared access. To provide this functionality and reduce repeated LMS verification overhead, Selectory may store encrypted LMS authentication artifacts and cached LMS metadata (such as course and quiz snapshots) for limited operational periods.

  • Selectory does not intentionally store plaintext LMS passwords in persistent storage.
  • You authorize Selectory to use provided LMS credentials to authenticate and refresh LMS state on your behalf.
  • If LMS authentication becomes invalid (including password changes), live LMS actions may be blocked until re-authentication succeeds.
  • If you connect to a shared LMS account, you represent and warrant that you are authorized to access and use that account and that all applicable account owners/participants have consented.

You are responsible for the security and lawful use of the LMS credentials and accounts you provide or link.

Credits & Payment

7.1 Credit System

The Service operates on a credit-based model. Credits are universal and never expire. One (1) credit entitles you to one (1) subject run, covering all quizzes within that subject and all automated retakes within your configured attempt allocation.

7.2 Payment Processing

All payments are processed by PayMongo, a third-party payment processor. We do not collect, process, or store any payment card information or GCash credentials. By making a purchase, you also agree to PayMongo’s terms of service and privacy policy.

7.3 Credit Deduction

Credits are deducted from your balance at the moment a run is started, not at the time of purchase. Your current credit balance is displayed in your account dashboard at all times.

7.4 Refund Policy

All purchases are final and non-refundable. Once a credit has been deducted and a run has been initiated, no refunds will be issued regardless of outcome - including quiz failures, scores below threshold, LMS access issues caused by incorrect credentials, or changes to LMS quiz availability.

If you believe you are entitled to a credit refund due to a verifiable platform error on our side, you may submit an appeal to tropeo123@gmail.com. Appeals are reviewed at our sole discretion. We aim to respond within seven (7) business days.

Automated Submission

Selectory does not automatically submit quizzes without your explicit confirmation, except in the following circumstance:

Emergency Auto-Submit: If ten (10) minutes or fewer remain on a Moodle quiz timer and you have not yet submitted your attempt, Selectory will automatically submit the quiz on your behalf to prevent the attempt from expiring. This action will be logged and you will be notified via your dashboard and email.

By using the Service, you consent to this auto-submission behavior. We are not liable for any scores or results arising from an auto-submitted attempt.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Attempt to reverse engineer, decompile, or extract source code of the platform.
  • Use automated scripts or bots to interact with the Service beyond its intended functionality.
  • Resell, sublicense, or commercially exploit the Service or your account without written consent.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.

Violation of this section may result in immediate account termination without refund.

Service Availability

We make no guarantee that the Service will be available at all times. The Service may be subject to downtime for maintenance, updates, or factors outside our control - including server outages, LMS changes, or third-party service disruptions.

We are not liable for any loss or damage arising from Service unavailability, including missed quiz deadlines or expired attempt timers during outages.

AI-Generated Answers

Selectory uses artificial intelligence to generate suggested answers to quiz questions. You acknowledge and agree that:

  • AI-generated answers are not guaranteed to be correct.
  • Accuracy varies depending on question type, phrasing, subject matter, and AI model limitations.
  • We make no warranty of any specific score, grade, or passing outcome.
  • You are given the opportunity to review AI-selected answers before submission and are encouraged to do so.

Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of credits due to user error (e.g., incorrect LMS credentials).
  • Academic penalties or disciplinary actions resulting from use of the Service.
  • Incorrect AI-generated answers resulting in failing quiz scores.
  • Low quiz or exam scores incurred while using the Service.
  • Loss of Moodle quiz attempts due to timer expiry or platform errors.
  • Service downtime during active quiz sessions.

By using the Service, you acknowledge that you take full responsibility and risk for your quiz and exam outcomes, including any low scores incurred.

Our total liability for any claim shall not exceed the amount you paid to us in the thirty (30) days preceding the claim.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service with an updated effective date. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms.

For material changes, we will attempt to notify registered users via email. It is your responsibility to review these Terms periodically.

Account Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. Any unused credits at the time of termination for cause are forfeited and non-refundable.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the appropriate courts of the Philippines.
